Terms of Use

These Terms of Use ("Terms") govern your access to and use of ApexOne VPN ("App", "we", "us", or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App, and uninstall it if it is already on your device.

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service and Google Play Developer Program Policies, as applicable. These Terms are intended to support lawful use of ApexOne VPN and to comply with those platform rules.

1. Eligibility

You must be at least 13 years of age (or the minimum digital-consent age required in your jurisdiction, such as 16 in certain regions) to use the App. If you are under the age of majority where you live, you may use the App only with the consent and supervision of a parent or legal guardian.

You are responsible for confirming that your use of VPN and connectivity services is permitted under the laws, regulations, and policies that apply to you, including rules of your employer, school, network provider, or country or region. We do not provide legal advice on whether VPN use is permitted in your location.

ApexOne VPN does not require you to create an account. You remain responsible for activity that occurs through the App on your device.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on supported Android devices that you own or control, for your personal, non-commercial use (unless otherwise authorized by us in writing). You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or create derivative works of the App except as expressly permitted by applicable law that cannot be waived.

3. Service Description

ApexOne VPN provides VPN tunneling and related connectivity features on supported Android devices. The App uses Android's VpnService API to route selected device traffic through configured VPN or proxy endpoints, which may help you manage your connection and reach network resources through the route you select.

ApexOne VPN is a connectivity tool only. It is not offered as a means to commit unlawful acts, to obtain unauthorized access to systems or content, or to violate the terms of other services. You remain responsible for complying with the terms of any website, application, or content provider you access while using the App.

Service availability, connection speed, server or node selection, and overall performance may vary based on network conditions, device compatibility, geographic location, third-party infrastructure, and maintenance. We do not guarantee uninterrupted, error-free, or consistently available service.

4. Acceptable Use

You agree to use ApexOne VPN only for lawful purposes. You must not use the App to:

• Violate any applicable local, national, or international law or regulation.
• Infringe intellectual property, privacy, publicity, or other rights of any person or entity.
• Access, copy, or distribute copyrighted material without authorization from the rights holder.
• Transmit malware, spam, phishing content, or other harmful or deceptive material.
• Probe, scan, disrupt, or attempt to gain unauthorized access to the App, our systems, or any third-party network or service.
• Interfere with or impose an unreasonable load on the service, other users, or connected infrastructure.
• Circumvent reasonable usage limits, security controls, or access restrictions in a manner that violates applicable law or third-party terms.
• Engage in fraud, harassment, abuse, exploitation of minors, or any activity that could harm us, our users, or third parties.

You are solely responsible for your conduct and for any content or data transmitted while connected through the App. We may suspend or terminate access if we reasonably believe these Terms have been violated.

5. Third-Party Content and Services

When you use the App, you may access websites, applications, or services operated by third parties. We do not control and are not responsible for third-party content, services, availability, or policies. Your use of third-party services is subject to their own terms and privacy practices. We do not endorse, and are not liable for, those third-party offerings.

ApexOne VPN may rely on third-party infrastructure, software development kits (SDKs), network providers, or proxy endpoints to deliver the service. We are not responsible for the acts or omissions of those third parties, except as required by applicable law.

6. Permissions and Device Features

The App requires Android VPN authorization and uses permissions necessary to operate a foreground VPN service, display connection notifications, and support related features, as described in our Privacy Policy. Android requires your explicit consent before a VPN tunnel can be established. You may decline that consent or revoke permissions through your device settings; doing so may limit or disable App functionality.

7. Advertising and Optional Paid Features

The App may display third-party advertisements, including through partners such as Google AdMob, when this feature is enabled. Ad delivery, measurement, and related data practices are subject to the terms and privacy policies of the relevant advertising partners. For more information, see our Privacy Policy.

If the App offers paid features, subscriptions, or in-app purchases through Google Play, those transactions are processed by Google. Pricing, billing, cancellation, and refunds for Play-billed purchases are governed by Google Play's terms and policies, in addition to these Terms. Unless required by law, fees are non-refundable except as provided by Google Play.

8. Intellectual Property

The App, including its name, branding, software, design, and related materials, is owned by us or our licensors and is protected by applicable intellectual property laws. Except for the limited license granted in Section 2, no rights are transferred to you under these Terms. All trademarks, service marks, and logos displayed in the App are the property of their respective owners.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App and all related services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free performance.

We do not warrant that the App will meet your requirements, that connections will always be secure or available, that defects will be corrected, or that the App will be compatible with every device or network environment.

10. Limitation of Liability

To the fullest extent permitted by law, ApexOne VPN and its operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded under applicable law, our total liability for any claim arising out of or relating to these Terms or the App shall be limited to the amount you paid to us for the App in the twelve (12) months preceding the event giving rise to the claim, or zero if the App was provided free of charge, unless a different mandatory limit applies in your jurisdiction.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory consumer-protection rights.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ApexOne VPN and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the App, your violation of these Terms, or your violation of any law or third-party rights.

12. Suspension and Termination

We may suspend, restrict, or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or if continued provision of the service is impractical or unlawful. You may stop using the App at any time by disconnecting the VPN and uninstalling the App from your device.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

13. Changes to the Service and Terms

We may modify App features, server or node availability, or these Terms from time to time. When we make material changes, we will post the updated Terms in the App or through our official channels and revise the "Last updated" date above. Your continued use of ApexOne VPN after the updated Terms become effective constitutes your acceptance of the changes, unless applicable law requires otherwise. If you do not agree to the updated Terms, you must stop using the App and uninstall it.

14. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information related to the service. Please review the Privacy Policy carefully before using the App.

15. Governing Law and Disputes

These Terms are governed by applicable law, without prejudice to mandatory consumer-protection rights that may apply in your jurisdiction and that cannot be waived by agreement. If a dispute arises, you agree to contact us first through the channels described in Section 18 and attempt to resolve the matter informally before pursuing other remedies, where permitted by law.

16. Entire Agreement and Severability

These Terms, together with the Privacy Policy and any in-app notices we present, constitute the entire agreement between you and us regarding the App, and supersede prior or contemporaneous communications on the same subject. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

Our failure to enforce any provision is not a waiver of that provision or of our right to enforce it later. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a reorganization, merger, or transfer of assets.
